1. Who you are contracting with

Bookavi (the "Service") is operated by BookAvi Ltd, registered in Scotland, trading as "Bookavi" ("Bookavi", "we", "us", "our"). By creating an account, accessing or using the Service you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The Service

Bookavi provides a software-as-a-service booking and customer-management platform for photo booth, 360, magic mirror, decor and event hire vendors, including services, packages, calendar, embeddable enquiry form, quote builder, deposit collection and customer CRM.

3. Your account

You must provide accurate information at signup and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose, fraud or spam;
  • infringe the intellectual property or privacy rights of any person;
  • upload malware, attempt to breach security, probe, scan, scrape or interfere with the Service;
  • resell, sublicense or white-label the Service except as expressly permitted in your plan;
  • reverse engineer the Service or circumvent its technical limits.

5. Intellectual property

Bookavi and our licensors retain all right, title and interest in and to the Service, including all software, documentation, branding and trademarks. You retain ownership of the content you upload, and grant us a limited, worldwide, royalty-free licence to host and process that content solely to provide the Service to you.

6. Service availability

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free performance. We may schedule maintenance and update the Service from time to time.

7. Subscriptions, billing and refunds

Paid subscriptions are billed monthly in advance at the price displayed at checkout (currently £9.99/month). Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries, handles returns and processes payments, tax and invoicing. By purchasing a subscription you also agree to Paddle's Buyer Terms.

You may cancel your subscription at any time from the billing portal. When you cancel, you will retain access to paid features until the end of the current billing period. Refund requests are handled in accordance with our Refund Policy.

8. Free trial

New accounts receive a 14-day free trial with no card required. At the end of the trial you must subscribe to continue using paid features.

9. Suspension and termination

We may suspend or terminate your access immediately if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly violate our policies. On termination, you may export your data within 30 days, after which we may delete it.

10. Disclaimer and liability

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties of merchantability and fitness for a particular purpose. Our aggregate liability arising out of or relating to these Terms is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages, loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify and hold us harmless against claims arising from your content, your unlawful use of the Service or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that we may bring proceedings in the country where you are resident.

13. Changes

We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days before they take effect.
